Health Care Centres are institutions which, because of their specificity and character, are particularly exposed to various kinds of risk. One of the most important and most frequently used methods of risk management is the black spots method. The research material collected for the study comes from one of the hospitals in Wrocław. All hospital stays of the C22 (Face and Jaw Surgery Ward) and H05 (Injury and Orthopaedics Surgery Ward) settlement groups (DRG) were analysed - a total of (...) 178 hospitalisations. The black spots method was used in the study, which consisted of risk identification, the ordering of threats and proposals for remedial actions. Using the black spots method, it was possible to identify adverse events that occurred during the hospitalisation of patients with H05 and C22 DRGs in the Injury and Orthopaedics Surgery Ward and Facial and Jaw Surgery Ward. In both cases, the treatment costs for patients with complications were higher than for the stays without complications. (shrink)

In this paper, I discuss the differences between ontic and epistemic conceptions of scientific explanation, mainly in relation to the so-called new mechanical philosophy. I emphasize that the debate on conceptions of scientific explanation owes much to Salmon’s ontic/epistemic distinction, although much has changed since his formulations. I focus on the interplay between ontic and epistemic norms and constraints in providing mechanistic explanations. My conceptual analysis serves two aims. Firstly, I formulate some suggestions for recognising that both sets of norms (...) and constraints, ontic and epistemic, are necessary for scientific theorising. Secondly, I emphasize that there are multiple dimensions involved in scientific explanation, rather than clear-cut alternatives between ontic and epistemic aspects. I conclude with a general observation that although contextual aspects of explanations are unavoidable, the epistemic-relativity of our categories, explanations and models can in fact be compatible with their objectivity. Instead of making hastily drawn ontological implications from our theories or models, we should carefully scrutinize them from the ontic-epistemic perspective. (shrink)

Despite their ethical intentions, ethically minded consumers rarely purchase ethical products (Auger and Devinney: 2007, Journal of Business Ethics76, 361–383). This intentions–behaviour gap is important to researchers and industry, yet poorly understood (Belk et al.: 2005, Consumption, Markets and Culture8(3), 275–289). In order to push the understanding of ethical consumption forward, we draw on what is known about the intention–behaviour gap from the social psychology and consumer behaviour literatures and apply these insights to ethical consumerism. We bring together three (...) separate insights – implementation intentions (Gollwitzer: 1999, American Psychologist54(7), 493–503), actual behavioural control (ABC) (Ajzen and Madden: 1986, Journal of Experimental Social Psychology22, 453–474; Sheeran et al.: 2003, Journal of Social Psychology, 42, 393–410) and situational context (SC) (Belk: 1975, Journal of Consumer Research2, 157–164) – to construct an integrated, holistic conceptual model of the intention–behaviour gap of ethically minded consumers. This holistic conceptual model addresses significant limitations within the ethical consumerism literature, and moves the understanding of ethical consumer behaviour forward. Further, the operationalisation of this model offers insight and strategic direction for marketing managers attempting to bridge the intention–behaviour gap of the ethically minded consumer. In a recent series of papers, Jane Friedman argues that suspended judgment is a sui generis first-order attitude, with a question as its content. In this paper, I offer a critique of Friedman’s project. I begin by responding to her arguments against reductive higher-order propositional accounts of suspended judgment, and thus undercut the negative case for her own view. Further, I raise worries about the details of her positive account, and in particular about her claim that one suspends judgment about (...) some matter if and only if one inquires into this matter. Subsequently, I use conclusions drawn from the preceding discussion to offer a tentative account: S suspends judgment about p iff S believes that she neither believes nor disbelieves that p, S neither believes nor disbelieves that p, and S intends to judge that p or not-p. The aim of this study is to justify the belief that there are biological normative mechanisms that fulfill non-trivial causal roles in the explanations (as formulated by researchers) of actions and behaviors present in specific systems. One example of such mechanisms is the predictive mechanisms described and explained by predictive processing (hereinafter PP), which (1) guide actions and (2) shape causal transitions between states that have specific content and fulfillment conditions (e.g. mental states). Therefore, I am guided by a specific (...) theoretical goal associated with the need to indicate those conditions that should be met by the non-trivial theory of normative mechanisms and the specific models proposed by PP supporters. In this work, I use classical philosophical methods, such as conceptual analysis and critical reflection. I also analyze selected studies in the field of cognitive science, cognitive psychology, neurology, information theory and biology in terms of the methodology, argumentation and language used, in accordance with their theoretical importance for the issues discussed in this study. In this sense, the research presented here is interdisciplinary. My research framework is informed by the mechanistic model of explanation, which defines the necessary and sufficient conditions for explaining a given phenomenon. The research methods I chose are therefore related to the problems that I intend to solve. In the introductory chapter, “The concept of predictive processing”, I discuss the nature of PP as well as its main assumptions and theses. I also highlight the key concepts and distinctions for this research framework. Many authors argue that PP is a contemporary version of Kantianism and is exposed to objections similar to those made against the approach of Immanuel Kant. I discuss this thesis and show that it is only in a very general sense that the PP framework is neo-Kantian. Here we are not dealing with transcendental deduction nor with the application of transcendental arguments. I argue that PP is based on reverse engineering and abduction inferences. In the second part of this chapter, I respond to the objection formulated by Dan Zahavi, who directly accuses this research framework of anti-realistic consequences. I demonstrate that the position of internalism, present in the so-called conservative PP, does not imply anti-realism, and that, due to the explanatory role played in it by structural representations directed at real patterns, it is justified to claim that PP is realistic. In this way, I show that PP is a non-trivial research framework, having its subject, specific methods and its own epistemic status. Finally, I discuss positions classified as the socalled radical PP. In the chapter “Predictive processing as a Bayesian explanatory model” I justify the thesis according to which PP offers Bayesian modeling. Many researchers claim that the brain is an implemented statistical probabilistic network that is an approximation of the Bayesian 7 rule. In practice, this means that all cognitive processes are to apply Bayes' rule and can be described in terms of probability distributions. Such a solution arouses objections among many researchers and is the subject of wide criticism. The purpose of this chapter is to justify the thesis that Bayesian PP is a non-trivial research framework. For this purpose, I argue that it explains certain phenomena not only at the computational level described by David Marr, but also at the level of algorithms and implementation. Later in this chapter I demonstrate that PP is normative modeling. Proponents of the use of Bayesian models in psychology or decision theory argue that they are normative because they allow the formulation of formal rules of action that show what needs to be done to make a given action optimal. Critics of this approach emphasize that such thinking about the normativity of Bayesian modeling is unjustified and that science should shift from prescriptive to descriptive positions. In a polemic with Shira Elqayam and Jonathan Evans (2011), I show that the division they propose into prescriptivism and Bayesian descriptivism is apparent, because, as I argue, there are two forms of prescriptivism, i.e. the weak and the strong. I argue that the weak version is epistemic and can lead to anti-realism, while the strong version is ontic and allows one to justify realism in relation to Bayesian models. I argue that a weak version of prescriptivism is valid for PP. It allows us to adopt anti-realism in relation to PP. In practice, this means that you can explain phenomena using Bayes' rule. This does not, however, imply that they are Bayesian in nature. However, the full justification of realism in relation to the Bayesian PP presupposes the adoption of strong prescriptivism. This position assumes that phenomena are explained by Bayesian rule because they are Bayesian as such. If they are Bayesian in nature, then they should be explained using Bayesian modeling. This thesis will be substantiated in the chapters “Normative functions and mechanisms in the context of predictive processing” and “Normative mechanisms and actions in predictive processing”. In the chapter “The Free Energy Principle in predictive processing”, I discuss the Free Energy Principle (hereinafter FEP) formulated by Karl Friston and some of its implications. According to this principle, all biological systems (defined in terms of Markov blankets) minimize the free energy of their internal states in order to maintain homeostasis. Some researchers believe that PP is a special case of applying this principle to cognition, and that predictive mechanisms are homeostatic mechanisms that minimize free energy. The discussion of FEP is important due to the fact that some authors consider it to be important for explanatory purposes and normative. If this is the case, then FEP turns out to be crucial in explaining normative predictive mechanisms and, in general, any normative biological mechanisms. To define the explanatory possibilities of this principle, I refer to the discussion of its supporters on the issue they define as the problem of continuity and discontinuity between life and mind. A critical analysis of this discussion and the additional arguments I have formulated have allowed me to revise the explanatory ambitions of FEP. I also reject the belief that this principle is necessary to explain the nature of predictive mechanisms. I argue that the principle formulated and defended by Friston is an important research heuristic for PP analysis. 8 In the chapter “Normative functions and mechanisms in predictive processing”, I start my analyzes by formulating an answer to the question about the normative nature of homeostatic mechanisms. I demonstrate that predictive mechanisms are not homeostatic. I defend the view that a full explanation of normative mechanisms presupposes an explanation of normative functions. I discuss the most important proposals for understanding the normativity of a function, both from a systemic and teleosemantic perspective. I conclude that the non-trivial concept of a function must meet two requirements which I define as explanatory and normative. I show that none of the theories I have invoked satisfactorily meets both of these requirements. Instead, I propose a model of normativity based on Bickhard's account, but supplemented by a mechanistic perspective. I argue that a function is normative when: (1) it allows one to explain the dysfunction of a given mechanism; (2) it contributes to the maintenance of the organism's stability by shaping and limiting possible relations, processes and behaviors of a given system; and when (3) (according to the representational and predictive functions) it enables explaining the attribution of logical values of certain representations / predictions. In such an approach, a mechanism is normative when it performs certain normative functions and when it is constitutive for a specific action or behavior, despite the fact that for some reason it cannot realize it either currently or in the long-term. Such an understanding of the normativity of mechanisms presupposes the acceptance of the epistemic hypothesis. I argue that this hypothesis is not cognitively satisfactory, and therefore the ontic hypothesis should be justified, which is directly related to adopting the position of ontic prescriptivism. For this reason, referring to the mechanistic theory of scientific explanations, I formulate an ontical interpretation of the concept of a normative mechanism. According to this approach, a mechanism or a function is normative when they perform such and such causal roles in explaining certain actions and behaviors. With regard to the normative properties of predictive mechanisms and functions, this means that they are the causes of specific actions an organism carries out in the environment. In this way, I justify the necessity of accepting the ontic hypothesis and rejecting the epistemic hypothesis. The fifth chapter, “Normative mechanisms and actions in predictive processing”, is devoted to the dark room problem and the related exploration-exploitation trade-off. A dark room is the state that an agent could be in if it minimized the sum of all potential prediction errors. I demonstrate that, in accordance with the basic assumption of PP about the need for continuous and long-term minimization of prediction errors, such a state should be desirable for the agent. Is it really so? Many authors believe it is not. I argue that the test of the value of PP is the possibility of a non-trivial solution of this problem, which can be reduced to the choice between active and uncertainty-increasing exploration and safe and easily predictable exploitation. I show that the solution proposed by PP supporters present in the literature does not enable a fully satisfactory explanation of this dilemma. Then I defend the position according to which the full explanation of the normative mechanisms, and, subsequently, the solution to the dilemma of exploration and exploitation, involves reference to the existence of constraints present in the environment. The constraints 9 include elements of the environment that make a given mechanism not only causal but also normative. They are therefore key to explaining the predictive mechanisms. They do not only play the role of the context in which the mechanism is implemented, but, above all, are its constitutive component. I argue that the full explanation of the role of constraints in normative predictive mechanisms presupposes the integration of individual models of specific cognitive phenomena, because only the mechanistic integration of PP with other models allows for a non-trivial explanation of the nature of normative predictive mechanisms that would have a strong explanatory value. The explanatory monism present in many approaches to PP makes it impossible to solve the problem of the dark room. Later in this chapter, I argue that the Bayesian PP is normative not because it enables the formulation of such and such rules of action, but because the predictive mechanisms themselves are normative. They are normative because they condition the choice of such and such actions by agents. In this way, I justify the hypothesis that normative mechanisms make it possible to explain the phenomenon of agent motivation, which is crucial for solving the dark room problem. In the last part of the chapter, I formulate the hypothesis of distributed normativity, which assumes that the normative nature of certain mechanisms, functions or objects is determined by the relations into which these mechanisms, functions or objects enter. This means that what is normative (in the primary sense) is the relational structure that constitutes the normativity of specific items included in it. I suggest that this hypothesis opens up many areas of research and makes it possible to rethink many problems. Despite increasing interest in studying arguments from deontic authority of the general form “(1) $$\delta$$ δ is a deontic authority in institution $$\varOmega$$ Ω ; (2) according to $$\delta$$ δ, I should do $$\alpha$$ α, C: therefore, (3) I should do $$\alpha$$ α ”, the state of the art models are not capable of grasping their complexity. The existing sets of critical questions assigned to this argumentation scheme seem to conflate two problems: whether a person is subject to an (...) authority of an institution in the first place and whether the command issued within the context of a particular institution is eventually binding. For this reason, we introduce (1) a set of Basic Critical Questions to scrutinize the former issue, and (2) a set of more detailed questions related to specific features, also referred to as “parameters”, of institutional environments (Intra-Institutional Critical Questions). We identify major elements of institutional environments in which authoritative utterances are made and the crucial parameters of arguments from deontic authority. The selected evidence from the decisions of the Polish Supreme Administrative Court helps us show how these parameters may be used to reconstruct subtypes of this argument scheme, with their associated sets of critical questions. In specific institutional contexts, such detailed schemes are capable of grasping the complexity of appeals to deontic authority and thus should be used rather than general schemes. The reconstruction of argumentation schemes with critical questions shows how particular arguments may successfully be attacked. (shrink)

Responding to the increasingly influential role of Hannah Arendt's political philosophy in recent years, Hannah Arendt and the Limits of Total Domination: The Holocaust, Plurality, and Resistance, critically engages with Arendt's understanding of totalitarianism. According to Arendt, the main goal of totalitarianism was total domination; namely, the virtual eradication of human legality, morality, individuality, and plurality. This attempt, in her view, was most fully realized in the concentration camps, which served as the major "laboratories" for the regime. While Arendt focused (...) on the perpetrators' logic and drive, Michal Aharony examines the perspectives and experiences of the victims and their ability to resist such an experiment. The first book-length study to juxtapose Arendt's concept of total domination with actual testimonies of Holocaust survivors, this book calls for methodological pluralism and the integration of the voices and narratives of the actors in the construction of political concepts and theoretical systems. To achieve this, Aharony engages with both well-known and non-canonical intellectuals and writers who survived Auschwitz and Buchenwald concentration camps. Additionally, she analyzes the oral testimonies of survivors who are largely unknown, drawing from interviews conducted in Israel and in the U.S., as well as from videotaped interviews from archives around the world. Revealing various manifestations of unarmed resistance in the camps, this study demonstrates the persistence of morality and free agency even under the most extreme and de-humanizing conditions, while cautiously suggesting that absolute domination is never as absolute as it claims or wishes to be. Scholars of political philosophy, political science, history, and Holocaust studies will find this an original and compelling book. (shrink)

Continual pressure on managers, their efficiency, and the need to search for novel solutions to problems can lead to psychologically demanding situations. In efforts to understand the main obstacles to work and to effectively manage work-related processes, and in the need to achieve personal development, new approaches that are based on existential philosophies emerge. The aim of this article is to highlight the ways in which existential approaches have been used or discussed in management and to show that existential themes (...) and their applications in management can also be found in the Eastern tradition of thought. The paper presents six case vignettes from management practice that use Western and Eastern existential insights and offer recommendations for self-development of managers. The paper concludes that although it is difficult or impossible to create a unified framework of existential philosophy of management because of the diversity of existential approaches and because of the problematic nature of comparing Eastern and Western philosophies, it is possible to work towards gathering applicable insights and values. This article responds to a call from Philosophy of Management (Vandekerckhove 2020) to open a discussion on the contribution of Albert Camus’s work to management. The aim of this article is to argue that Camus’s sense of cyclicality related to the recurrence of crises is particularly important for existential management. This idea is embodied primarily by Camus’s famous retelling of the myth of Sisyphus, which is not only a provocative metaphor of his thoughts, as discussed by many authors, but (...) is also an inspiring expression of the idea of ​​revolt, which is further developed in Camus’s later work. The article focuses on recent updates to Camus’s Sisyphean revolt in existentially oriented approaches to management. These are mainly the concepts of the existential manager, an analysis of managerial lived experience within existential hermeneutic phenomenology, and the perspective of an absurd organization. Camus’s motif of cyclicality represents a stimulating framework for analysing lived managerial experience, which is characterized by alternating phases of success and failure. The article also draws attention to other important motives in Camus’s work, such as avoiding extremes and idealistic constructs, and expressing the value of human life as a basis for ethical behaviour. All the mentioned motives are closely related to the concept of revolt. This article also provides several explanatory comments on the editorial, which help to take a closer look at Camus’s style of thinking and avoid possible misinterpretations. In this respect, the distinction between Camus’s approach and forms of existentialism is particularly important. (shrink)

This paper critically assesses the possibility of moral enhancement with ambient intelligence technologies and artificial intelligence presented in Savulescu and Maslen (2015). The main problem with their proposal is that it is not robust enough to play a normative role in users’ behavior. A more promising approach, and the one presented in the paper, relies on an artifi-cial moral reasoning engine, which is designed to present its users with moral arguments grounded in first-order normative theories, such as Kantianism or utilitarianism, (...) that reason-responsive people can be persuaded by. This proposal can play a normative role and it is also a more promising avenue towards moral enhancement. It is more promising because such a system can be designed to take advantage of the sometimes undue trust that people put in automated technologies. We could therefore expect a well-designed moral reasoner system to be able to persuade people that may not be persuaded by similar arguments from other people. So, all things considered, there is hope in artificial intelli-gence for moral enhancement, but not in artificial intelligence that relies solely on ambient intelligence technologies. (shrink)

It has been noticed by several authors that the colloquial understanding of anonymity as mere unknown-ness is insufficient. This common-sense notion of anonymity does not recognize the role of the goal for which the anonymity is sought. Starting with the distinction between the intentional and unintentional anonymity (which are usually taken to be the same) and the general concept of the non-coordinatability of traits, we offer a logical analysis of anonymity and identification (understood as de-anonymization). In our enquiry, we focus (...) on the intentional aspect of anonymity and develop a metaphor of “anonymity game” between “perpetrator” and “detective”. Beginning from common-sense intuitions, we provide a formalized, critical notion of anonymity. (shrink)

While mainstream CSR research has generally explored and argued for positive ethical, social and environmental performance, critical CSR scholars argue that change has been superficial—at best, and not possible in any substantial way within the current capitalist system. Both views, however, only address the role of business within larger systems. Little attention has been paid to the everyday material CSR practice of individual managers. We go inside the firm to investigate how the micro-level acts of individual managers can aggregate to (...) drive transformation of the macro-level business logic. We draw on the strategy-as-practice approach to organize our research. The study reveals two orientations towards the integration of personal ethics into the workplace: abdication and activism. These orientations are supported by managerial practice such as reproductive and coping tactics and covert and overt tactics ; and, three enabling conditions of activist practice: empowerment and psychological safety, moral shock, and morality praxis. While our findings illustrate the tremendous challenges managers face when attempting to influence organizational practices towards their ethical and environmental aspirations, we also show that under specific conditions, individual managers can become fully engaged advocates and drivers of positive change from the inside. In so doing, our individual-level analysis of intrapreneurship provides a more complex picture of the possibilities for positive change than have been previously put forth by mainstream and critical CSR research. ABSTRACT Schopenhauer's argument against suicide has served as a punching bag for many modern-day commentators. Dale Jacquette, Sandra Shapshay, and David Hamlyn all argue that the premises of this argument or its conclusion are inconsistent with Schopenhauer's wider metaphysical and ethical project. This paper defends Schopenhauer from these charges. Along the way, it examines the relations between suicide, death by voluntary starvation, negation of the will, compassion, and Schopenhauer's critiques of cynicism and stoicism. The paper concludes that there may (...) be gaps in Schopenhauer's system, but not where the aforementioned commentators tried to locate them. (shrink)

Firms’ choice of legal regime is not uniform. Despite Delaware’s significant advantages and success in attracting corporations, many firms still choose to incorporate in their home state, and some firms incorporate in a third state, most notably Nevada. Several factors - lawyers’ advice, political influence in the home state, and relative costs of out of state incorporation - were identified as contributing to these patterns. Yet none of these factors neither their combination, fully account for firms’ choices. This Article suggests (...) that unidentified heterogeneity, potentially in managers’ preferences for legal protection, might have contributed to, and could help in explaining, these patterns. Among other factors, this heterogeneity could result, for example, from variations in market forces and, in turn, private benefits that managers extract. Introducing heterogeneity in managers’ preferences, this Article suggests that managers that share a relatively strong preference for insider protection should be less inclined to incorporate in Delaware, and more inclined to incorporate in their home state where they have political clout, or in Nevada if their strong preference for protection is not satisfied in their home state. The analysis is too preliminary for normative implications to be derived, rather the Article suggests that more research into firms’ heterogeneity and their choice of law could prove valuable. This book presents the current state of the art regarding the application of logical tools to the problems of theory and practice of lawmaking. It shows how contemporary logic may be useful in the analysis of legislation, legislative drafting and legal reasoning concerning different contexts of lawmaking. Elaborations of the process of lawmaking have variously emphasised its political, social or economic aspects. Yet despite strong interest in logical analyses of law, questions remains about the role of logical tools in lawmaking. (...) This volume attempts to bridge that gap, or at least to narrow it, drawing together some important research problems-and some possible solutions-as seen through the work of leading contemporary academics. The volume encompasses 20 chapters written by authors from 16 countries and it presents diversified views on the understanding of logic (from strict mathematical approaches to the informal, argumentative ones) and differentiated choices concerning the aspects of lawmaking taken into account. We propose that the metaphor of cleansing was a by-product of modernization processes. Based on cultural and historical evidence, we claim that the activation of cleansing metaphor triggered positive associations in times when separation was a positively regarded element of human culture and agriculture, but it should not exert the same effect in times when separation became culturally anachronistic.

Apart from the Treaty of human nature, political philosophy of David Hume's not systematic. This fact is probably associated with Hume's skepticism, disbelief in the philosophical, abstract synthesis, which necessarily reduces the complexity of the world to just one aspect. Most distinct evidence of this belief are philosophical essays, often recognized for popularizing some of the ideas contained in the Treaty. Popularization of the former no doubt, but there were also more than that. Hume They analyzed human reason and (...) morality in a very broad historical context. Essays are full of details taken from the history of culture, politics and the economy in both England and the ancient peoples. Greeks and Romans had for special esteem for Hume, and ancient historians considered it his pattern, moreover, does not mean that he was against them uncritically. (shrink)

This article is a short presentation of the problem of individual liberty – as we understand it today – in the context of the problematic of Goodness in Plato’s philosophy of politics as presented in his two main political dialogues: the Republic and the Laws. The crucial distinction is for me dichotomy: negative vs. positive liberty as defined by Isaiah Berlin following Benjamin Constant. In this article I also consider to what extent justifiable is liberal critique of Plato as a (...) totalitarian. At the end of the text I suggest that the best interpretation of Plato’s vision would be its treatment not so much as a strictly political one but rather as a program of education of the soul based on specific understanding of politics derived from Plato’s anthropology. Martin Buber’s The Question to the Single One appeared in Nazi Germany at a time, when collectivism in its totalitarian forms was at the height of its development. On one hand this little book is an immediate reaction to the social-political situation in inter-war Europe. On the other hand it is a consideration of the anthropological question of the modern man from the point of view of dialogical personalism. The paper focuses on Buber’s critique of both the individualistic and (...) collectivistic doctrines of ethical relativism. It examines also his category of the “single one in responsibility” as a response to both doctrines. (shrink)

The seventh volume of the Collected Works of Michal Kalecki, one of the twentieth century's preeminent economists, contains his empirical studies of the wartime and post-war economy in Britain and the USA, together with papers on the work of other economists and miscellanea.The first part of the book collects together his articles on the economic conditions of Britain during the Second World War, focusing on the rationing of consumption and war finance, and its post-war reconstructions. These articles are among (...) Kalecki's best known, and contributed significantly to his world renown as an economist. Part two contains studies of post-war America, comparing the economy with the situation before the War. Part three contains a group of articles under the title `Political economy and economists', and includes book reviews and essays on the study of economics. Part four collects essays on a variety of topics, including Polish economic planning, construction engineering, and the theory of numbers. As in previous volumes, editorial notes and annexes by Professor Osiaty'nski provide invaluable background information and explanatory glosses on the main text. Among other things, they reveal details of Kalecki's work for the United Nations.Since this is the final volume of the Collected Works, it concludes with a chronology of biographical information and a complete bibliography of Kalecki's writings from 1927 to 1987. Despite the fact that Husserl did not write a book on aesthetics, it is widely accepted that a Husserlian aesthetics can be developed from his writings. In this article, I describe and analyze a feature of Husserlian aesthetics which I call the “radical individuality of the aesthetic object.” This radical individuality stems from Husserl’s interpretation of aesthetic consciousness in terms of the neutrality modification. I make the case for a radical reading of the neutrality modification by contrasting it (...) with the inactuality modification and the notion of foundation and I argue that the neutrality modification must be kept distinct from these concepts. I further describe the concept of the radical individuality of the aesthetic object by reference to Ingarden’s notion of the aesthetic object as monosubjective. The thesis of the radical individuality of the aesthetic object prima facie leads Husserlian aesthetics close to axiological relativism expressed in the adage that de gustibus non est disputandum. I explain that despite such proximity, Husserlian aesthetics does not entail an axiological relativism and does not preclude discussions concerning aesthetic values. On the contrary, Husserlian aesthetics ultimately shows that such discussions are necessary for keeping the possibility of aesthetic perception itself alive, and thereby encourages such discussions. I conclude with a practical demonstration of the results of my Husserlian analyses by critically engaging some aspects of Proust’s theory of art in À la recherche du temps perdu. (shrink)

Giubilini and Savulescu in their recent Journal of Bioethical Inquiry symposium article presented an account of conscientious objection that argues for its recognition as a non-financial conflict of interest. In this short commentary, I highlight some problems with their account. First, I discuss their solicitor analogy. Second, I discuss some problems surrounding their objectivity claim about standards of medical care. Next, I discuss some issues arising from consistently applying their approach. Finally, I highlight that conscientious objection should be viewed (...) not as a conflict of interest but as something that society has an interest in preserving. I conclude by arguing that clinicians who have a conscientious objection can be treated in the same way as those who decide to subspecialize and do not need to give up work in their specialty. While Giubilini and Savulescu present an interesting argument about conscientious objection, theirs is not a compelling view. Indeed, the way we approach conscientious objection has more to teach us about conflicts of interest than the other way around. (shrink)

This essay characterizes the perception of the visual hybrid as nonconceptual, introducing the terminology of nonconceptual content theory to aesthetics. The visual hybrid possesses a radical but nonetheless exemplary aesthetic composition and is well established in culture, art, and even design. The essay supplies a philosophical analysis of the results of cross-cultural experiments, showing that while categorization or conceptual hierarchization kicks in when the visual hybrids are juxtaposed with linguistic descriptions, no conceptual scheme takes effect when participants are presented with (...) mere visual hybrids. In isolation, the hybrids do not lend themselves to classification. I draw four conclusions from these experimental outcomes: 1. The perception of visual hybrids follows the structure of a nonconceptual mental content, because the original categories or concepts of the hybrids’ components are not combined into one, and their properties are not applied to one another, therefore none of the components reconstructs the other such that it is introduced to a new category. 2. Language freezes the hybridity of the visual hybrid into conceptuality. 3. Given that language has a freezing effect in the case of an extreme visual phenomenon such as the hybrid, it is all the more restraining in moderate artistic compositions, such as visual metaphors, in which properties of one component (the source) are applied to the other (the target). In those, nonconceptuality emerges from relatively organized compositions, forms, and relations, and from the dependence of objects and their properties on perceptual context. 4. Thus, the nonconceptualist terminology is suitable for the analysis of aesthetic perception in general and aesthetic perception’s relation to language. This paper offers a theoretical framework that can be used to derive viable engineering strategies for the design and development of robots that can nudge people towards moral improvement. The framework relies on research in developmental psychology and insights from Stoic ethics. Stoicism recommends contemplative practices that over time help one develop dispositions to behave in ways that improve the functioning of mechanisms that are constitutive of moral cognition. Robots can nudge individuals towards these practices and can therefore help (...) develop the dispositions to, for example, extend concern to others, avoid parochialism, etc. (shrink)

Humans often seek to improve themselves, whether through self-discipline or through the use of science and technology. At some point in the future, techniques might become available that will change humans to such a degree that they might have to be regarded as something other than human: posthuman. This essay tries to define the point at which such a human-to-posthuman metamorphosis may occur. This is achieved by discerning what is it that makes human substance distinct, i.e. what is the human (...) essence. This is accomplished by examining the features of the human body, looking at the mode of human existence in society and trying to grasp the importance of the body–soul relationship. Throughout the process, humans are compared to animals as well as entities from literature, film, and the gaming world. These are used as case studies to shape and test the ideas developed throughout the essay. Social media have become a standard in contemporary communication. That is especially true for business which jumped at the opportunity to con­nect with current and prospective customers allowing them to integrate with their favourite brands and products even further. This trend, however, seems to be absent in the public domain. Local authorities notice social media but attempt to use it in a one-to-many format, which is incompatible with the interactive nature of the new medium. This paper provides an analysis of Martin Buber’s not very well-known essay “Distance and Relation”, which is his most relevant contribution to philosophical anthropology. In the essay, which was published almost thirty years after the publication of his most famous book, I and Thou, Buber elaborated on the anthropological foundations of his cosmic vision of dialogical life. The central question is “How is man possible?” Buber’s answer is very important to the further development of his principle of dialogue in psychology (...) (primarily his notion of confirmation) and philosophy of art, but it is not quite clear how compatible it is with some of his earlier theses from I and Thou. In particular, the relation between “distance” and the I-It relation is unclear. There are two seemingly contradictory statements: “In the beginning is the relation” and “The primal distance is a presupposition of the relation”. The aim of this paper is to examine these anthropological foundations and to elucidate this apparent contradiction. (shrink)

Neonatal professionals encounter many ethical challenges especially when it comes to interventions at the limit of viability (weeks 22–25 of gestation). At times, these challenges make the moral dilemmas in neonatology tragic and they require a particular set of intellectual and moral virtues. Intellectual virtues of episteme and phronesis, together with moral virtues of courage, compassion, keeping fidelity to trust, and integrity were highlighted as key virtues of the neonatal professional. Recognition of the role of ethics requires a recognition that (...) answering the obvious question (what shall we do?) does not always suffice. Acknowledging the tragic question (is any of the alternatives open to us free from serious moral wrongdoing) and recognizing the ethical dilemmas, where the lines between right and wrong are blurred, leads to actions taken towards establishing ethics frameworks to support decision-making. In neonatology units, such organizational support can help in allowing the team members to recognize the ethical dilemmas, avoid moral distress, and improve team cohesion and the quality of care provided. Only when the organizational structure allows ethical dilemmas to be recognized, adequate decisions can be made. (shrink)

There is an ethical dilemma present when considering updating predictive clinical artificial intelligence (AI) models, which should be part of the departmental quality improvement process. One needs to consider whether withdrawing the AI model is necessary to obtain the relevant information from a naive patient population or whether to use causal inference techniques to obtain this information. Withdrawing an AI model from patient care might pose challenges if the AI model is considered standard of care, while use of (...) causal inference will not be reliable if the relevant statistical assumptions do not hold true. Hence, each of these two updating strategies is associated with patient risks, but lack of reliable data might endanger future patients. Similarly, not withdrawing an outdated AI might also expose patients to risk. Here I propose a high level ethical framework – epistemic risk management - that provides guidance for which route of model updating should be taken based on the likelihood of the assumptions used during the creation of the original AI model and the assumptions required for causal inference holding true. This approach balances our uncertainty about the status of the AI as standard of care with the risk of not obtaining the necessary data, so as to increase the probability of benefiting current and future patients for whose care the AI is being used. The case of Alta Fixsler, where a judge ruled that withdrawing life sustaining care was in her best interest rather than transferring her to Israel, as her parents wanted, is the latest in a series of controversial paediatric best interest decisions. Using this case, as well as some other recent cases, I argue that the UK exhibits a high degree of medico-legal paternalism in best interest decisions, even though paternalism seems to be ubiquitously negatively perceived in medical ethics. Firstly, I (...) explain what I mean by medico-legal paternalism and defend my claim that this phenomenon is present in the UK. I then argue that at least philosophically (rather than legally) such a situation is impossible to justify in a secular state and that how we treat paediatric best interest decisions is very different from other areas of medical law. This paper follows on from a brief debate about the role of conscientious objection in healthcare, where the issue arose as to whether conscientious objection is (or can) be a tool of resistance against systemic injustice. The paper contributes to this debate by highlighting that some authors generally opposed to conscientious objection in healthcare have shown some support to this idea. Perhaps if there is one area in which all can agree, it is that in healthcare conscientious objection should (...) be allowed so as to prevent cases of systemic injustice. (shrink)

Judgments differ from decisions. Judgments are more abstract, decontextualized, and bear fewer consequences for the agent. In pursuit of experimental control, psychological experiments on bias create a simplified, bare-bone representation of social behavior. These experiments resemble conditions in which people judge others, but not how they make real-world decisions.

People make different choices depending on which decision is the default option. In intertemporal choices, the default option is typically imposed externally. For example, people expect more for delaying the gain than are willing to pay for accelerating the future gain over the same period. We claim that apart from the external default, people’s choices are also influenced by the internal default such as the time perspective resulting in the reference point in the present. By manipulating the congruency between (...) the internal and external defaults, we show that incongruence between defaults decreases the strength of discounting of gains, but not of losses. The submitted contribution is devoted to the controversy in Martin Buber’s conception of responsibility and especially to the question whether its nature is reciprocal or asymmetrical. This controversy arises from a misunderstanding and misinterpretation of his concept of mutuality as a constituent of I-Thou relation. Several refuting arguments are offered against the claim that the mutuality of the I-Thou relationship means equality of responsibility which enables ethical calculus.

Andrzej Dragan’s book Quantechism or a cage for people is a great popular science book to start a fascinating adventure with the theory of relativity and quantum mechanics. It is written in an easy language, does not require from the reader a deep knowledge of contemporary physical issues, while describing, illustrating and explaining them very well. Instead, it requires broader historical knowledge and at least basic philosophical knowledge for verification, helping to bring out what is most valuable in the (...) book. Unfortunately, the book, while popularizing science, also makes a terrible mess and does a lot of damage to the deeper understanding of physics, its history, and the meaning and function of philosophy and religion. And so it can become an attractive and appealing, but nevertheless a trap-cage for thinking people. (shrink)

Wesley Wildman's and Kate Stockly's book Spirit Tech - The Brave New World of Consciousness Hacking and Enlightenment Engineering is an interesting compilation and analysis of current research on technologies of spiritual experience. The book offers the latest in neuroscience, very bold predictions about the development of spirituality technology, and very far-reaching conclusions about the development of religion. The authors take an interdisciplinary approach to their work, touching on neuroscience, medical engineering, psychology, religion, and ethics. They do not shy away (...) from the big philosophical, psychological, and ethical questions, and they specifically focus on questions of authenticity, meaning, safety, and social responsibility arising from the marriage of technology and spirituality. Modern neuroscience along with engineering has already created new areas of science-faith and technology-faith relationships. Technological substitutes for spirituality are also increasingly becoming a new challenge to traditional spirituality and to religion. (shrink)

Classical logic, of first or higher order, is extended with sentential operators and quantifiers, interpreted substitutionally over unrestricted substitution class. Operators mark a single layered, consistent metalanguage. Self-reference, arising from substitutional quantification over sentences, allows to express paradoxes which, unlike contradictions, do not lead to explosion. Semantics of the resulting language, using semi-kernels of digraphs, is non-explosive yet two-valued and has classical semantics as a special case for clasically consistent theories. A complete reasoning is obtained by extending LK with (...) two rules for sentential quantifiers. Adding (cut) yields a complete system for the explosive semantics. (shrink)

This article presents qualitative research conducted in an Israeli ova `extraction' clinic in Romania. Following on from a piece written by Jyotsna Gupta and published in this journal in February 2006, this article asks what kinds of feminist alliances can or should be made in the arena of reproductive technologies. In conversation with Gupta, the author asks whether `an ethic of universal human dignity' is possible or desirable. This article looks to the voices of Romanian egg sellers themselves as (...) a source of theoretical and political direction for transnational feminists who try to think about responses to reproductive technologies. This article discusses a rare instance of the highest national courts explicitly addressing traffic signs in their judgments or decisions. It critically examines the standpoint expressed by the Polish Constitutional Tribunal and the Supreme Court, according to which the basic traffic sign categories in Poland—obligatory, prohibitory, informative and warning—are not separable [e.g. prima facie non-normative signs can also be normative ]. These courts formulated this idea when addressing the legal question concerning the applicability of legal provision penalizing failure to comply (...) with a traffic sign to parking a car without paying a fee in an area marked by an informative sign that indicates the need to charge a fee for parking. The article analyses and criticizes the relevant standpoint of the Polish Constitutional Tribunal and the Supreme Court. It shows how many negative consequences can result from frivolous treatment and neglect of traffic signs. It also reconstructs some possible practical recommendations concerning not only traffic signs but also visualizations of legal rules in general. (shrink)

This article presents an argument for the view that we can perceive temporal features without awareness. Evidence for this claim comes from recent empirical work on selective visual attention. An interpretation of selective attention as a mechanism that processes high-level perceptual features is offered and defended against one particular objection. In conclusion, time perception likely has an unconscious dimension and temporal mental qualities can be instantiated without ever being conscious.

Objective:This study explored the psychological and academic effects of studying online from the home vis-à-vis host country during the coronavirus disease 2019 (COVID-19) pandemic in the experience of international students at the University of Warsaw, Poland.Methods:A total of 357 international students from 62 countries (236 in the host country and 121 in the home country) completed an online questionnaire survey 2 months after transition to online learning. We studied students' levels of loneliness, life and academic satisfaction, acculturative stress, (...) academic adjustment, performance, loyalty, and perceptions of the online learning experience.Results:The country-of-residence variable had no statistically significant effects on most psychological and academic variables. Significant effects were observed only for two academic variables. Specifically, students who returned to the home country found online communication with other students more contributing to their online learning experience and exhibited higher academic adjustment than students who remained in the host country. This suggests the positive influence of (peer and familial) support on online learning experience from the home country. Furthermore, a significant difference in experiencing acculturative stress occurred for students in quarantine/self-isolation in the host country, which expands prior literature on the disruptive effects of social distancing on students' mental health. Finally, this study confirmed the expected increased levels of loneliness among self-isolating students in both countries, hence extending prior results to the home- and host-country contexts. No relationship between self-isolation and students' life or academic satisfaction was found, which is explained by the specific nature of the learning-from-home experience. (shrink)

Robin Horton has studied modes of thought for decades. His attitude is strongly "intellectualist" and directed against "symbolic" interpretation in anthropology A contrast between these two standpoints is regarded in this paper as axiomatic, derived from worldview assumptions presented as a scientific debate. Divergences concern isssues such as the objective status of human cognition, the degree of rationality of a given thought system, and the desirable status of anthropological interpretations of human thought. Horton's standpoint is criticized, mainly his views (...) on the universality of standards of rationality established in the West, and the presentism of his "cognitive foundationalism," which claims that cognition is the primary function of any thought/belief system. His intellectualist position is placed in the context of contemporary postmodern anthropological discourses. (shrink)
